What Washington Law Requires Before You Move With Your Child

Washington law sets strict rules about moving with your child when a parenting plan is in place. The law requires written notice to the other parent no less than 60 days before you relocate, including your new address, schedule changes and your reasons for relocating.

The other parent has 30 days to object; without an objection, courts typically allow the move. If they object, a judge weighs your child’s best interests and may revise the parenting plan.

What Factors Does A Washington Judge Consider In A Relocation Case?

A judge does not approve relocation at random. The court weighs specific relocation factors to determine what serves your child’s best interests:

  • The bond your child shares with each parent
  • Each parent’s involvement history
  • The concrete benefits the move brings to your child’s daily life
  • Each parent’s willingness to support the other parent’s role
  • The child’s age, needs and school connections
  • The wishes of a mature child
  • The impact on each parent and child if relocation is approved or denied

We build a case around these factors and present it with force.

Building A Long-Distance Parenting Plan After Relocation

When a parent relocates, the parenting schedule almost always changes. Long-distance parenting plans typically include extended blocks of time during school breaks and summers rather than frequent short visits. Courts also address how the child travels between homes and who covers transportation costs.

Virtual visitation keeps your child connected to the parent who stays behind, and Washington courts recognize these virtual visits as a meaningful part of long-distance parenting. We help you build a plan that protects your child’s bond with both parents, wherever you live.
